Legal terms

Terms & Conditions

These Terms govern your use of the Westfield Rocks Referral Group website, applications, communications, events, and membership services.

Revised June 1, 2026

These Terms and Conditions (“Terms”) form an agreement between you and Westfield Rocks Referral Group (“Westfield Rocks,” “WRRG,” “we,” “us,” or “our”).

The Terms apply when you access or use our website (the “Site”), submit an inquiry or application, participate in an event, receive communications, or use services offered by Westfield Rocks.

Please read these Terms carefully. They include a binding arbitration provision and limitations of liability.

1. Acceptance of These Terms

By accessing the Site, submitting information, applying for membership, or using our services, you acknowledge that you have read and agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Site or submit an application. Additional terms may apply to particular events, payments, screening processes, or services.

You must be at least 18 years old and legally able to enter into these Terms.

2. Organization and Mission

Westfield Rocks Referral Group is an Indiana-based nonprofit professional networking organization. Its mission is to bring local professionals together to build trusted relationships, exchange quality referrals, support one another’s businesses, and make a positive difference in the Westfield community.

If Westfield Rocks is recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code, membership payments should not be treated as charitable contributions unless Westfield Rocks identifies a deductible portion in writing.

Membership does not provide an ownership interest in Westfield Rocks or governance rights except as expressly provided in applicable governing documents.

3. Permitted Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms.

You may not:

  • Provide false, misleading, fraudulent, or incomplete information.
  • Attempt to gain unauthorized access to the Site or related systems.
  • Interfere with the Site’s operation, availability, or security.
  • Introduce malicious code, automated scraping tools, or harmful material.
  • Impersonate another person, organization, member, or representative.
  • Use Site content or member information for unsolicited marketing.
  • Use the Site in violation of applicable law or another person’s rights.

We may restrict or terminate access when we reasonably believe these Terms have been violated.

4. Membership Applications and Approval

Submitting an application does not guarantee membership. The Membership Committee may evaluate:

  • Industry-seat or professional-classification availability.
  • Professional experience and standing.
  • Required licenses, certifications, insurance, or registrations.
  • Application accuracy and completeness.
  • Background-screening results.
  • Alignment with Westfield Rocks’ mission and policies.
  • The interests and integrity of the organization.

Membership begins only after final approval, completion of required screening, payment of applicable annual dues, and delivery of an acceptance notice.

Westfield Rocks may approve, deny, defer, or condition applications to the extent permitted by applicable law.

5. Professional and Industry Classifications

Westfield Rocks generally permits one approved member for each professional or industry classification.

Exclusivity is limited to the specific products or services approved by the Membership Committee. A business offering multiple services does not automatically hold every related classification.

The Membership Committee may define, divide, clarify, modify, reassign, or resolve overlapping classifications based on the products and services actually represented and the organization’s reasonable needs.

Classification exclusivity is a membership policy and does not guarantee referrals, customers, revenue, or protection from competition outside Westfield Rocks.

6. Fees, Dues, and Refunds

Application fee $40

Submitted with the application, used for the required background check, and nonrefundable.

Annual membership dues $300

Collected separately after final membership approval.

The application fee remains nonrefundable even when an application is denied, withdrawn, incomplete, or not advanced.

If an approved member withdraws within 30 calendar days after acceptance, $150 of the annual membership dues will be refunded. The remaining dues and application fee will not be refunded.

Unless required by law or stated otherwise in writing, no refund is available after the 30-day period. Fees and policies may be updated prospectively, with notice provided when reasonably practical.

Applicants must not submit payment-card, bank-account, Social Security, birth-date, or driver’s-license information through a general website form. Secure payment or screening instructions will be provided separately.

7. Professional Qualifications

Applicants and members are responsible for maintaining every license, certification, registration, permit, insurance policy, and qualification required for their profession and services.

Members must promptly notify Westfield Rocks if a required credential is restricted, suspended, revoked, surrendered, or allowed to expire.

Westfield Rocks may request reasonable documentation confirming professional standing. Membership does not constitute a certification, endorsement, warranty, or guarantee of a member’s qualifications or services.

8. Background Screening

Membership requires successful completion of Westfield Rocks’ background-screening process.

Applicants who advance will receive separate disclosure, authorization, and screening materials through Westfield Rocks or its designated provider. Applicants must provide accurate information and cooperate with reasonable verification requests.

Applications and preliminary approvals remain conditional until screening is completed and reviewed. Screening information will be handled according to applicable law, provider requirements, and our Privacy Policy.

9. Independent Businesses and Referrals

Members operate as independent businesses and professionals. Membership does not create an employment, partnership, joint venture, franchise, fiduciary, agency, or representative relationship between Westfield Rocks and a member or among members.

Westfield Rocks facilitates networking and referral opportunities but does not guarantee:

  • Any minimum number or value of referrals.
  • Customers, clients, contracts, sales, revenue, or profit.
  • The accuracy of information supplied by a member.
  • The quality, safety, legality, or outcome of a member’s work.
  • Payment or performance under an agreement between third parties.

Each person is responsible for conducting appropriate due diligence before making or accepting a referral, purchasing services, or entering into an agreement.

10. Conduct, Suspension, and Termination

Applicants and members must act honestly, professionally, respectfully, and consistently with Westfield Rocks’ mission, governing documents, Code of Ethics, policies, and applicable law.

Grounds for discipline, suspension, denial, or termination may include:

  • Material misrepresentation or omission.
  • Loss of a required professional credential.
  • Failure to pay required amounts.
  • Unlawful, fraudulent, discriminatory, or unethical conduct.
  • Harassment, threats, abuse, or harmful behavior.
  • Misuse of Westfield Rocks’ name, materials, or information.
  • Material violations of organizational policies.
  • Conduct reasonably likely to harm the organization, its members, or the public.

When reasonably practical, Westfield Rocks will provide notice and an opportunity to respond. Temporary suspension may be imposed when reasonably necessary to protect the organization, its members, its reputation, or the public.

11. Content and Intellectual Property

The Site and its original text, graphics, branding, layout, photographs, videos, and other content are owned by or licensed to Westfield Rocks and protected by applicable intellectual-property laws.

You may view and use Site content for personal, informational, and legitimate membership-related purposes. You may not copy, distribute, modify, publish, sell, license, or commercially exploit Site content without written permission.

If you submit a testimonial, photograph, video, business description, logo, or other content for publication, you represent that you have the right to provide it. Subject to any separate agreement, you grant Westfield Rocks a nonexclusive, worldwide, royalty-free license to use, reproduce, display, format, and distribute that content for organizational, promotional, and community purposes.

You may withdraw permission for future promotional use by contacting us. Withdrawal does not require recall of materials already printed or distributed.

12. Electronic Communications

By submitting an application, inquiry, registration, or payment, you consent to receive operational communications reasonably necessary to process the transaction and administer your relationship with Westfield Rocks.

Operational communications may concern applications, screening, payments, meetings, events, security, policies, or membership. Marketing consent is optional and is not a condition of membership.

You may unsubscribe from marketing email using the link provided in the message. An opt-out from marketing does not prevent nonmarketing operational communications.

14. Privacy

Our collection, use, storage, and disclosure of personal information are described in the Westfield Rocks Privacy Policy.

Third-party providers—including website hosting, form processing, payment, communications, analytics, and screening providers—may apply their own terms and privacy policies.

15. Disclaimers

To the fullest extent permitted by law, the Site, services, content, networking opportunities, referrals, and membership benefits are provided “as is” and “as available.”

Westfield Rocks disclaims warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and results to the fullest extent permitted by law.

16. Limitation of Liability

To the fullest extent permitted by law, Westfield Rocks and its officers, directors, committee members, volunteers, employees, and agents will not be liable for indirect, incidental, consequential, exemplary, special, or punitive damages arising from the Site, membership, participation, communications, referrals, or these Terms.

To the fullest extent permitted by law, their total combined liability for claims arising from membership or participation will not exceed the membership dues paid by the claimant during the 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the provisions apply only to the maximum extent permitted by law.

17. Binding Arbitration

Except for matters that applicable law does not permit to be arbitrated, disputes arising from these Terms or participation in Westfield Rocks will be resolved through binding arbitration administered by the American Arbitration Association under its applicable rules.

Unless otherwise agreed or required by law, arbitration will take place in Indiana. Fees and expenses will be allocated under the applicable arbitration rules and law.

By agreeing to binding arbitration, you and Westfield Rocks may be waiving the right to have a dispute decided by a judge or jury in court.

Before initiating arbitration, the complaining party should send a written description of the dispute and requested resolution to the contact address listed below and allow 30 days for an informal resolution attempt.

18. General Provisions

Governing law

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles, except where federal law controls.

Entire agreement

These Terms, the Privacy Policy, applicable application terms, governing documents, Code of Ethics, membership policies, and other written terms accepted by an applicant or member constitute the applicable agreement.

Severability

If a provision is invalid or unenforceable, it will be enforced to the fullest lawful extent, and the remaining provisions will continue in effect.

No waiver

A failure to enforce a provision does not waive the right to enforce it later.

Assignment

You may not transfer your rights or obligations under these Terms without written consent. Westfield Rocks may transfer its rights and obligations as part of an organizational transaction or as otherwise permitted by law.

We may revise these Terms periodically. Updated Terms will be posted with a new revised date. Continued use after that date constitutes acceptance of the revised Terms to the extent permitted by law.
